General conditions of sale for stays in guest rooms - Villa Herbert - Sarl Jali - Andernos Les Bains
ARTICLE I – GENERAL PROVISIONS: The tenant may not under any circumstances claim any right to remain in the premises at the end of the rental period specified in the contract, unless with the written agreement of the owner. No modification (deletion, addition, etc.) will be accepted in the wording of the contract without the agreement of both parties. The owner undertakes not to disclose to any third party any information of any nature whatsoever, on any medium whatsoever, that the tenant may have provided to him during the execution of this contract. However, these latter provisions are not applicable to requests for information that may be made by administrations and/or the courts.
ARTICLE II – VALIDATION OF A RESERVATION: Stays are guaranteed only upon receipt of a deposit, deductible from the invoice upon arrival.
Deposit requested:
-50% of the total price of the stay. Your reservation will be firm upon receipt of a deposit. The payment of a deposit implies acceptance of these general conditions of sale for stays in guest rooms. In all cases, a stay in a guest room at Villa Herbert implies full acceptance of these general conditions of sale for stays in guest rooms.
ARTICLE III – CANCELLATION BY THE CUSTOMER: Any cancellation must be notified by email with acknowledgment of receipt or letter addressed to the owner.
Cancellation before the start of the stay:
-The customer can cancel their reservation free of charge up to 30 days before the start date of the stay.
-The customer will not be able to claim any refund of the deposit if he cancels his reservation within 30 days prior to arrival, consequently the deposit remains acquired by the owner.
-In case of cancellation 72 hours before the scheduled arrival date, the balance of the stay is fully due by the customer.
-In the event of a shortened stay and/or no-show, for whatever reason, the price corresponding to the cost of accommodation remains entirely acquired by the owner and will therefore be invoiced in full to the customer.
-To avoid any inconvenience regarding the cancellation of your stay, we suggest you take out cancellation insurance.
ARTICLE IV – CANCELLATION BY THE OWNER: When the owner cancels the stay before the start of the stay, he must inform his client by registered letter with acknowledgment of receipt or e-mail. The customer, without prejudice to any recourse for compensation for any damages suffered, will be immediately reimbursed for any sums already paid. He will also receive compensation at least equal to the penalty he would have incurred if the cancellation had been made by him on that date.
ARTICLE V – ARRIVAL TIME: The client must arrive on the day specified in the reservation contract and at the times mentioned below. Rooms are available from 5:00 p.m. Please notify us if you plan to arrive after 8:00 p.m.
ARTICLE VI – DEPARTURE TIME: Room departure time must be no later than 10:30 a.m.
ARTICLE VII – PAYMENT OF THE BALANCE FOR ACCOMMODATION: The balance for your stay must be paid during your stay. Any additional services and amenities not mentioned in this contract will be paid at the end of your stay.
ARTICLE VIII – TOURIST TAX: The tourist tax is a local tax that the customer must pay to the owner who then pays it to the public treasury.
ARTICLE IX – CHANGE OF ROOMS: Without the customer being entitled to any compensation, the operator reserves the right to change the room initially reserved by the customer to a room of the same or higher capacity. In such a case, the cost of the reservation remains unchanged.
ARTICLE X – PETS: are accepted upon request to management.
Article XI-Swimming Pool and Spa
Use of the family pool is at your own risk.
The family pool is open seasonally (April to November in general) weather permitting in the morning from 9 a.m. to 8 p.m. Any minor child, not accompanied by an adult parent, is not authorized to access the pool area.
The owners remind their guests that the pool is not supervised. Its use is reserved for owners, family members, and guests staying in guest rooms.
Children's use of the pool is under the full supervision and sole responsibility of their parents. Running, jumping, and diving are prohibited to avoid disturbing the well-being of our guests and, above all, to ensure your own safety. The owners decline all responsibility in the event of an accident or drowning.
All users of the swimming pool are advised to be covered by Civil Liability insurance for defense and recourse.
The spa is accessible free of charge during the winter, with mandatory hygiene and good manners rules. It is not available during maintenance days.
Pool users agree to shower before swimming, to use a swimsuit reserved solely for swimming, to use their own bath towels (room towels are not intended for use outside the rooms), and not to bring food or drinks into the pool.
ARTICLE XII – ART OF LIVING: All guests are required to adhere to a certain art of living to ensure the tranquility of the premises and the comfort of their guests. In addition, guests are kindly requested not to smoke in the rooms. The guest agrees to respect the instructions for use of the premises as stated in the rooms and in these general terms and conditions of sale. The guest agrees to return the rooms in perfect condition at the end of their stay and to declare, and assume financial responsibility for, any possible damage for which they may be responsible. Children staying at Villa Herbert are under the sole and complete responsibility of their parents. Access to the property and the swimming pool are reserved exclusively for guests staying at Villa Herbert.
ARTICLE XIII - These conditions of sale are subject to change at any time without notice. Acceptance and compliance with these conditions of sale are deemed to have been acquired upon payment of the deposit, in all cases from the start of the stay in the guest room.
ARTICLE XV – INSURANCE: The tenant is required to insure the premises entrusted to him or rented. He must therefore check whether his main residence contract provides for the holiday extension (vacation rental). Otherwise, he must contact his insurance company and request an extension of the guarantee or take out a special contract under the "holiday" clause. He will be asked for proof of insurance upon entering the premises or, failing that, a sworn statement.
ARTICLE XIV - In accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you. Villa Herbert undertakes not to transmit,
Information that you have provided to other companies or organizations.
ARTICLE XVI – DISPUTE: In accordance with Article L.612.1 of the Consumer Code, you can use the MEDICYS mediation service, to which we belong, free of charge:

In the event of a dispute and in the absence of an amicable agreement, for all disputes arising from the execution or interruption of this contract, only the Courts of the jurisdiction of the location of the property subject to the rental shall have jurisdiction. Only French law shall apply to this contract.
Instructions for use related to swimming pool safety
NONE OF THE PROTECTIVE DEVICES WILL EVER REPLACE ADULT VIGILANCE: NONE OF THESE DEVICES IS 100% INFALLIBLE.
The physical presence of a responsible adult is essential when the pool is open
This safety blanket is not a substitute for common sense or individual responsibility. Nor is it intended to replace the vigilance of parents and/or responsible adults, which remains the essential factor in the protection of young children.
1) Information on the risks of drowning:
-Any body of water presents a potential danger for children, especially if they are very young and cannot swim.
-Warning: a child can drown in less than 3 minutes in 20 cm of water.
2) Information on general prevention measures:
-A security device does not in any way replace the vigilance of responsible adults, who must exercise constant and active supervision.
-You should never let a child access a swimming pool alone, leave them there alone or take your eyes off them, even for a few moments.
-When swimming, it is strongly recommended that young children be equipped with floating devices (adapted buoy; armbands; floating swimsuits, etc.)
-Your children's safety depends on you! The risk is highest when children are under five years old. Accidents don't just happen to other people! Be prepared to face them!
Monitor and act:
-Children must be closely and constantly supervised;
- Designate a single security officer;
- Reinforce surveillance when there are several users in the pool;
-Wet your neck, arms and legs before entering the water;
- Prohibit running, diving and lively games around the pool;
-Never allow a child to go alone near any water source.
-Never take your eyes off your child
To ensure that swimming remains a pleasure, be vigilant and apply preventive measures.
ARTICLE XVII: the loan of bicycles:
BICYCLE INSTRUCTIONS
We provide bicycles free of charge.
THEY ARE PERMANENTLY MAINTAINED BY A PROFESSIONAL AND JEAN-BERNARD.
AS THIS IS NOT A RENTAL THERE ARE SOME INFORMATION YOU NEED TO KNOW:
- Please take care of them, attach them well and if you take baskets remember to attach them as well or remove them from the bikes
- If you have a puncture or if you derail during your rides, know that WE WILL NOT COME AND PICK YOU UP, remember to take anti-puncture sprays especially for longer journeys, there are bike rental shops all over Andernos as well as in the other towns of the Bassin, they will be able to help you out (costs at your expense)
